With this deposit you agree that you & all guests are 21 years of age or older & will adhere to all policies & regulations set forth the ABC, each venue, and Cork & Keg Tours (CAKT). Failure to comply may result in removal from the venue and- in case of over-intoxication or unruliness will require alternate transportation (paid for/arranged by depositor or guest in violation). No one who exhibits symptoms of illness (including but not limited to sneezing, coughing, fever, etc.) will be allowed to board the CAKT vehicle or participate in the tour. All venues reserve & will enforce the right to deny entry to anyone for any reason. If you or anyone in your party falls ill prior to the tour, our cancellation policy is in effect; however, we will work with you to reschedule applying the amount due as a credit. If anyone in your party is turned away on the date of the tour, the full tour amount due will be charged. Party-size based arrangements or pre-paid deposits may be due in full, regardless of no-shows or non-participation. Guest sickness, damage to the Sprinter, or mess requiring professional cleaning: depositor or responsible party will be charged a minimum of $800 on site. Should the damages exceed $600, or CAKT is unable to fulfill a tour due to damage caused, the depositor and/or responsible party will cover all repair/cleaning & lost income costs. For cancellations beyond CAKT's control (weather, venue closings, van complications, etc.): every effort will be made for an alternate date, or a 100% deposit will be refunded minus a $10 processing fee.
This appointment cannot be cancelled online. CAKT's cancellation policy: 30 days or more notice will receive deposit back minus $10 processing fee, unless itinerary planning has begun more than 30 days in advance of the tour. The deposit becomes non-refundable when itinerary planning begins, or within 15- 29 days of the tour date. Full tour rate will be charged for cancellations within 14 or less days' notice. Party size is finalized 7 days prior to your tour date for parties of 7 or more. Should your party size decrease below 7 guests within 3-7 days of your tour, you will be charged $50 per canceled guest. Guest cancellations within 2 days (48 hours) or less of the tour date/start time and no shows will be charged the full amount per seat.
This Agreement and the Attachments hereto constitute the entire agreement between the contracting parties concerning the subject matter hereof. All prior agreements, discussions, representations, warranties and covenants are merged herein. There are no warranties, representations, covenants or agreements, expressed or implied, between the parties except those expressly set forth in this agreement. Any amendments or modifications of this agreement shall be in writing and executed by the contracting parties.
This Agreement shall be governed and interpreted by the laws of the Commonwealth of Virginia and any litigation or disputes arising from this agreement will be litigated in the Loudoun County courts.
This agreement is made upon the express condition that Cork and Keg Tours, its representatives and employees shall be free from all liabilities and claims for damages and/or suits for or by reason of any injury, illness or death to any person participating in this tour.
